Montgomery County Judicial Appeals of ARB Hearing

The king of post-administrative appeals is the judicial appeal. Designed to handle the biggest properties in Texas, judicial appeals are lawsuits that have been the domain of the wealthy for years. As Montgomery County becomes more affluent and property values ascend to new heights, judicial appeals are becoming more attractive to taxpayers every year.

The final fight against the Montgomery Central Appraisal District (MCAD) will require a taxpayer to assemble a legal team, find and pay expert witnesses, and gather a lot of evidence. Or they could let O’Connor handle the whole judicial appeal and simply wait for victory in the courts. O’Connor has been a constant foe of appraisal districts across Texas for 50 years and will gladly represent you on the biggest stage. Best yet, you will not pay a single cent unless you win your lawsuit against MCAD.

MCAD Judicial Appeals Filed by Property Type

Commercial properties have traditionally been the centerpiece of judicial appeals across Texas. This is certainly the case in Montgomery County, as 252 of the 504 judicial appeals filed in 2023 were for commercial properties. While these businesses made up 50% of all judicial appeals, single family homes made a good showing for themselves with 122 lawsuits. While that may seem small, it is incredibly rare for a county to see 24.21% of judicial appeals be single family homes. This reflects both the residential nature of Montgomery County and the caliber of residential properties found there.

MCAD Value Involved in Judicial Appeals

2023 saw the most value ever contested by judicial appeals in Montgomery County at $6.16 billion. This was up from the previous peak of $4.18 billion in 2022. The value appealed increased 128.12% from 2021 and 533.44% from 2014. Montgomery County has increased greatly in value in the previous decade, and the value of judicial appeals reflects that. The rising amount also means that there are more prestige properties in the county than ever before.

In a somewhat surprising move, the biggest value contested was for multi family homes, with $3.32 billion in value on the line. The longtime champion commercial properties had a bit of a slip, falling to $2.02 billion. Single family homes were involved in more lawsuits than ever recorded and notched a solid $606 million. Montgomery County is the hottest place to live in the Houston area, so it is no wonder that apartments are becoming a priceless commodity.
